Terms of service

This is a translation for your convenience. The Spanish version is the binding one and prevails over this translation in case of any discrepancy.

These terms govern the use of Orbit, the operating system for online stores provided by Melsho ("we", "us"). By creating an account or using the service, the contracting store ("the customer") and every person who signs in with their user accept them.

The service

Orbit centralizes orders, stock, catalog, payments, finance, customer service and metrics from the channels the customer connects (for example Shopify, Mercado Libre, Mercado Pago, social networks and shipping and invoicing services), and includes artificial intelligence features.

Each store has its information in a separate data space. The features available depend on the plan purchased and on the integrations the customer turns on.

Accounts and access

The customer appoints its administrators and is responsible for who has access to its store, for the permissions it grants them and for keeping its credentials confidential. It must notify us immediately if it suspects unauthorized access.

The credentials of the platforms the customer connects are stored encrypted and used only to operate its own store.

Acceptable use

The customer undertakes to use Orbit for the legitimate management of its business, to respect the terms of the platforms it connects, and not to attempt to access other stores’ information, breach the security of the service or use it to send unsolicited communications.

Artificial intelligence

The assistant, the customer service bot and the content tools generate automatic responses that may contain errors. Actions that talk to third parties, move money or stock, or change listings and tax documents require a person’s confirmation. The customer is responsible for reviewing what it publishes or sends.

Each plan includes a monthly AI usage cap; once it is reached, those features are paused until the following month or until the cap is raised.

Plans, trial and payments

New stores may start with a trial period. When it ends, or if a payment is pending, the store may be suspended: its users will not be able to operate it, but the data is kept and updates from the connected channels are processed when it is reactivated.

Prices, payment method and invoicing are agreed in the commercial proposal or on the current plans page (https://moldarte-moldapp-web.f5puiw.easypanel.host/planes).

Customer data

The data the customer enters or that comes from its channels belongs to the customer. We process it as processors, under the Privacy policy and the Data processing agreement, to provide the service and for no other purpose.

The customer may request a full export of its store’s data at any time. When the service ends, we keep the data for 30 days to allow that export and then delete it, unless the law requires us to keep it.

Availability and support

We work to keep Orbit continuously available, with daily backups and monitoring, but the service also depends on third-party platforms (sales channels, payments, shipping, AI) whose availability we do not control.

Support is provided through the channels indicated in the application.

Liability

To the maximum extent permitted by law, our total liability to the customer for any claim related to the service is limited to the amount paid by the customer in the three months before the event giving rise to it. We are not liable for lost profits or for damages arising from failures of third-party platforms.

Closing the store

The store’s owner can close it at any time from Settings › Your data, after downloading the full export. Once closed, it stops working and its data is kept for 30 days for a new download; after that period we delete it, unless the law requires us to keep it.

Changes and governing law

We may update these terms; relevant changes are announced at least 15 days in advance. These terms are governed by the laws of Uruguay, and its courts have jurisdiction over any dispute.
